  • Important Procedures & Legal Requirements when Purchasing a Property in Spain for UK Non Residents.
    • A 10% deposit is required to confirm the offer and to take the property off the market, in some cases a smaller deposit can be paid and a transfer of the balance paid by transfer. Credit card payments are subject to a 2.5% surcharge.
    • You will be required to sign a purchase agreement contract in Spanish/English.
    • You must agree a completion date at the time of signing the contract suitable for both parties. If a mortgage is required the completion date will be subject to mortgage.
    • Under Spanish law you are required to have a Spanish bank account, this can be done whilst you are here and only takes half an hour, you need your passport and a UK address is required. Have your legal advisor check outstanding debts on the property before you sign for your Deeds
    • You need to appoint and instruct a legal representative or solicitor to represent you on your purchase, it is advisable to meet with them before you return to the UK so that they can explain the buying process and legal requirements as you must supply them with all relevant documentation, if this is not possible you can contact them by email, Fax or phone as soon as possible when you return back to the UK. You will be required to sign a purchase agreement contract in Spanish/English. (It is your legal representatives responsibility to ensure that all documentation is correct, calculate all taxes to be paid, arrange a notary appointment for the transfer of the title deeds to the buyer, and calculate the agreed declared purchase price. If you are completing on a private sale agreement this will be done at your legal representatives office. The purchaser needs to ensure that their legal representative transfers electricity, water and telephone contracts into the buyers name upon completion. Failure to do this can result in the supplies being disconnected.)
    • An NIE number is required upon completion, your legal representative can assist you in obtaining them, you must allow at least 45 days for them to be issued.
    • You will need to make a Spanish will for your protection; again your legal representative will arrange this.
    • You will need to have cleared funds in your Spanish account before completion, please allow sufficient time for transfers to arrive; it can take up to 7 days from the UK.
    • We would advise that you arrive in Spain at least 24hours prior to completion.
    • Make sure you have arranged your flights and accommodation allowing sufficient time to complete and finalise.
    • We recommend to all our clients to stay in contact with us and should you have any problems please let us know and we will do our best to help. We must be informed of any private transactions between you and the seller, i.e. payments for additional items being left or changes to the completion dates.     • Luz Del Sol ask all vendors to supply a list of items being included in the sale which should be included with the purchase agreement .It is not Luz Del Sols responsibility to check that these items have been left once the vendors have vacated the property, your legal representative will assist you should a problem arise.
    • Once the contract or agreement has been signed it is difficult sometimes impossible to change details such as add a name or take a name off, please ensure any changes are requested well in advance of the completion date, notary charges may apply and are the purchasers responsibility.
