Driving under the influence of toxic drugs, narcotics or any other substances, including medicines, which may affect one's mental or physical ability in driving, is prohibited.

All vehicle drivers involved with traffic accidents are obliged to take a mandatory drugs and alcohol consumption test.

Seatbelts and helmets.
The use of seatbelts is compulsory on all roadways, both urban and rural, for the driver and passengers of cars and vans and for the front seat passengers of lorries of a maximum weight allowance of 3,500kgs and of buses with a maximum weight allowance of 5,000kgs

Motorcyclists and moped riders must wear an approved type of safety helmet on all journeys.

Fines and Fining Procedures.
Offenders of traffic laws who are fined and cannot produce proof of their residence in Spain, are obliged to deposit the money on the spot, guarantee its payment through any means allowed under Spanish law (for example, any Spanish citizen may assume responsibility for the fine). In the event that the fine is not paid immediately, or its payment is not guaranteed, the vehicle of the offender will be immobilised.

A written appeal may be sent in Spanish or in any other language to the traffic authorities "Jefatura Provincial de Trafico" of the province where the offence was commited. If the fine is upheld the deposit will be kept. If not, it will be returned.

Other Prohibitions

  • To drive while wearing earphones or headphones connected to any audio source or when using hand-held telephones.
  • To throw cigarette ends or any object which may cause fires or other damage on to the roadway or surrounding areas.
  • To drive a vehicle which emits excessive fumes or smoke.
  • To stop or park on the carriageways or hardshoulder of main roads, except in emergencies.

Always make sure that your vehicle (brakes, steering, suspension, lights, etc.) is in good working order and that you are yourself in a fit condition to drive.
